Two Tractor Trailers Crash Near Gas Station
A two tractor-trailer crash occurred on January 5, 2023 in Cato, New York. The crash happened at around 5:30 p.m. on Route 370. The first tractor-trailer operator, Robert Charles Powell (62) from Duanesburg, had supposedly not yielded to the right of way when turning onto the street from within a parking lot at a Speedway gas station. His truck hit another tractor-trailer, which was being operated by David H. Malone (47) of Syracuse and traveling eastbound.
Based on what troopers reported, Malone had been flown by helicopter to Syracuse for treatment at the Upstate University Hospital. The condition of his injuries were not specified and more information about his injuries had not been available. Powell, the first truck driver, did not sustain injury. But both tractor-trailers needed to be towed away from the scene due to substantial damage. Route 370 had to be shut down for several hours for investigation and cleanup.
Rarely do you hear about a collision between two commercial trucks. In the example provided here, there seem to be many unknowns. For those who have been victims in truck-related accidents, they may not be aware of all the factors that contributed to the incident unfolding. Instead of making assumptions or automatically believing the at-fault driver’s claims, we suggest having our team at Truck Law investigate further.
Unfortunately, because there tends to be significant property damage and personal injury when a New York truck accident happens, trucking companies may go to extreme lengths to avoid liability. You may find that after our investigation, there are multiple potential parties who share liability. For instance, the truck driver may have been operating the vehicle for longer than mandates allow, increasing the chances of an accident. But then, it’s possible that the loading team had not properly balanced the truck before having it start its route. But that also could mean the trucking company itself is partially responsible because they did not ensure that their workers did their job correctly, which ultimately led to the public being put at risk.
It is highly recommended that you hire a lawyer if you are not sure how to move forward with a claim after a truck accident.
